Drug-Free Workplace Policy (RA11313)
SciBiz Informatics Inc is committed to safeguarding the health of its employees and maintaining a safe, productive work environment. The company recognizes that the use of dangerous drugs is detrimental to the physical and mental well-being of workers and is a risk to workplace safety. Therefore, it is the policy of the Company to remain a Drug-Free Workplace. This policy applies to all employees of the Company, regardless of rank, status, or salary, including those working off-site or on field assignments.
Prohibited Acts
The following are strictly prohibited and shall be considered Grave Misconduct:
- The use, possession, sale, distribution, or manufacture of dangerous drugs (as defined by RA 9165) within company premises or during work hours.
- Reporting for work while under the influence of dangerous drugs.
- Refusal to undergo a mandatory or random drug test without a valid medical or legal reason.
Drug Testing Program
To ensure compliance, the Company shall implement the following testing protocols:
- Pre-Employment Testing: All successful applicants must pass a drug test at a DOH-accredited laboratory before being hired.
- Random Testing: The Company shall conduct unannounced random drug testing. Employees will be selected using a neutral selection process.
- For-Cause Testing: Conducted when there is "reasonable suspicion" (e.g., erratic behavior, slurred speech, or physical evidence).
- Post-Accident Testing: Conducted following a workplace accident that results in injury or significant property damage.
Procedures for Positive Results
- Confirmatory Test: If an initial "screening" test returns a positive result, a Confirmatory Test must be conducted using Gas Chromatography-Mass Spectrometry (GCMS) or an equivalent validated method.
- Challenge: An employee who tests positive has the right to challenge the result within fifteen (15) days of receipt of the notice.
- Confidentiality: All test results shall be treated as strictly confidential medical records and handled only by the Authorized Specimen Collector, the HR/Admin Manager, and the Company Head.
Treatment and Rehabilitation
- Referral: Any employee who tests positive for drug use (and is not found to be "selling" or "distributing") may be referred to a DOH-accredited physician for a dependency assessment.
- Rehabilitation: If the employee is found to be drug-dependent, they may be required to undergo a rehabilitation program.
- Cost: The cost of the Drug Test is shouldered by the Employer. However, the cost of the Rehabilitation Program is generally shouldered by the Employee, unless otherwise specified by company discretion.
Disciplinary Action
- First Offense (Positive Result): If an employee tests positive and refuses rehabilitation, or if they are found to be selling/distributing drugs, the penalty is Dismissal.
- Refusal to Test: Any employee who willfully refuses to submit to a drug test shall be subject to immediate disciplinary action, up to and including Dismissal for insubordination.
- Return to Work: An employee who completes rehabilitation must pass a "Return-to-Duty" drug test and may be subject to frequent "follow-up" testing for a specified period.
