Safe Spaces & Anti-Sexual Harassment Act Policy - RA 11313

SciBiz Informatics Inc values the dignity of every individual and guarantees full respect for human rights. The Company adopts a Zero-Tolerance Policy toward gender-based sexual harassment (GBSH). We are committed to providing a safe and respectful work environment free from all forms of sexual harassment, whether physical, verbal, or online.

Sexual harassment is defined as any unwelcome sexual advance, request for sexual favors, or other conduct of a sexual nature that affects the dignity of a person. These acts are prohibited even if they occur between peers, from a subordinate to a superior, or via digital/online channels.

  • Verbal/Non-Physical Acts: Catcalling, wolf-whistling, leering/intrusive gazing, cursing, persistent uninvited comments on appearance, or sharing "green" jokes.
  • Online Acts: Sending obscene messages, non-consensual sharing of photos/videos with sexual undertones, cyberstalking, or any unwelcome sexual remarks on social media or work chats.
  • Physical Acts: Touching, pinching, brushing up against the body, or any uninvited physical contact.
  • Quid Pro Quo: Demanding sexual favors in exchange for hiring, promotion, salary increases, or continued employment.

Committee on Decorum and Investigation (CODI)

The Company shall maintain a CODI as an independent internal mechanism to address complaints.

Composition: The CODI must be led by a woman, and at least half of its members must be women. It shall include representatives from: Management Supervisory Rank Rank-and-File Employees

Duties: The CODI is responsible for receiving complaints, conducting fair investigations, and recommending sanctions to Management.

Grievance Procedure

  • Filing: A victim may file a written or verbal complaint to HR or any member of the CODI.
  • Investigation: The CODI must begin the investigation within ten (10) days of receipt.
  • Confidentiality: The identity of the victim and the details of the case shall be kept strictly confidential to protect all parties.
  • Due Process: The respondent (the accused) shall be given a "Notice to Explain" and an opportunity to be heard.

Non-Retaliation & Support

  • Zero Retaliation: Any form of retaliation against a person who reports harassment or testifies in an investigation is a Grave Offense. This includes demotion, unfair performance reviews, or social exclusion.
  • Victim Support: The Company will provide a safe environment for victims and may refer them to psychological counseling or legal assistance if necessary.

Penalties

Violations of this policy are categorized by gravity (Light, Less Grave, or Grave).

Grave Offenses (e.g., physical assault, Quid Pro Quo, or repeat offenses) shall result in Immediate Dismissal, without prejudice to criminal charges under Philippine law.
